Plain-English summary: getmem.ai is provided as developer infrastructure. You are responsible for what you build, store, process, generate, retrieve, or deploy with it. 1. Agreement to these Terms

These Terms of Service ("Terms") govern your access to and use of getmem.ai, including our website, APIs, documentation, SDKs, hosted services, dashboards, and related tools (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

7. AI systems, memory, and outputs

The Service may extract, summarize, embed, retrieve, rank, or return memory context for use by AI systems. AI-related outputs may be incomplete, inaccurate, outdated, biased, unsafe, or unsuitable for your use case. You are responsible for testing, reviewing, monitoring, and deciding whether any memory item, retrieved context, or AI output is appropriate to use.

We are not responsible for how your application interprets, displays, combines, acts on, or exposes memory data or AI-generated content.

8. Availability and changes

We aim to provide a reliable Service, but we do not guarantee that it will be uninterrupted, error-free, secure, or available at all times. We may modify, suspend, throttle, degrade, or discontinue any part of the Service at any time, including for maintenance, security, abuse prevention, legal compliance, or product changes.

9. Accounts, API keys, and security

You are responsible for keeping your accounts, credentials, API keys, tokens, and integrations secure. You are responsible for all activity under your account or keys, whether or not authorized by you. Notify us promptly if you believe your credentials or systems have been compromised.

10. Fees and plans

Paid plans, credits, usage limits, and pricing may be described on the website, in an order form, or in your account. Unless otherwise stated in writing, fees are non-refundable, usage is measured by our systems, and we may change pricing or plan features prospectively. You are responsible for taxes, charges, and usage generated by your account.

The Service may interoperate with third-party AI model providers, infrastructure providers, analytics tools, SDKs, package managers, hosting platforms, and other external services. We are not responsible for third-party services, their availability, their terms, their security, or their handling of data. Your use of third-party services is governed by their own terms.

We and our licensors own the Service, including software, APIs, documentation, designs, trademarks, and other materials. Except for rights expressly granted in these Terms, no rights are transferred to you. You may not copy, modify, reverse engineer, resell, or create competing services from the Service except where permitted by law or by an applicable open-source license.

We do not warrant that the Service, memory retrieval, AI outputs, integrations, documentation, examples, or generated content will be accurate, complete, safe, lawful, compliant, uninterrupted, or suitable for your specific use case.

15. Limitation of liability

To the maximum extent permitted by law, getmem.ai and its owners, employees, contractors, affiliates, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages; loss of revenue, goodwill, data, customers, opportunities, or business interruption; or any damages arising from your applications, users, Customer Data, AI outputs, decisions, or third-party services.

To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the three months before the event giving rise to the claim, or (b) USD $100.

You agree to defend, indemnify, and hold harmless getmem.ai and its owners, employees, contractors, affiliates, suppliers, and licensors from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising from or related to your use of the Service, your applications, your users, Customer Data, your breach of these Terms, or your violation of law or third-party rights.

You may stop using the Service at any time. We may suspend or terminate your access at any time if you breach these Terms, create risk, fail to pay fees, or use the Service in a way we reasonably believe is unlawful, abusive, or harmful. After termination, some provisions will continue, including those relating to ownership, disclaimers, limitation of liability, indemnity, and dispute resolution.
